Post-divorce, or during a divorce proceeding, the circumstances of each parent may change. Courts typically retain jurisdiction over each case. If you believe the circumstances warrant a change in an order of custody, the argument must be put before the court. In this, as always in matters of custody, the childs’ best interest will be the primary consideration. Any matter which the Court may consider in the initial custody determination may be considered in a petition for modification.
